Article 1 - General
GUINEE MILLIONS processes personal data of Site Players for the purposes and within the limits of the Privacy Policy during any visit or use of it.
Players are presumed, by accessing the Site, to have acknowledged and accepted the Privacy Policy. They guarantee that the data and information communicated to GUINEE MILLIONS are accurate.
Article 2 - Processing of personal data not requiring the consent of the Players
2.1. Obligations of GUINEE MILLIONS
GUINEE MILLIONS is bound by legal and regulatory obligations to which any online gaming and betting operator is subject on the one hand, and for the purpose of authenticating and enabling Players to use the Site on the other, to process the following personal data for the purposes described below. This processing of personal data by GUINEE MILLIONS does not require the consent of the Players.
Personal data communicated by the Player are recorded in a registry as described in Article 7.1, which is controlled and remains at all times under the responsibility of GUINEE MILLIONS.
Types of data
The personal data processed include:

Names, first names, date of birth, language, sex, home/postal address, National Registry Number (or identity card or passport number), email address, fixed or mobile telephone number;

Copies of personal documents for Player authentication such as identity card photo, account statement, proof of deposits, or any other document proving domicile and/or residence of the Player;

Player's browsing and activity histories on the Site including gaming histories (casino and sports betting), their transactions (winnings and losses, deposits, withdrawals), connections (browser data, IP address), particularly through cookies;

Any other information that may be exchanged between GUINEE MILLIONS and the Player, particularly by email or live chat as part of their registration or use of the online gaming services offered on the Site.
Processing of data
The processing involves the collection, recording, preservation, consultation, organization, use, matching, or any other operations rendered necessary or useful by virtue of the legal and regulatory provisions described in Article 2.1.c).
Furthermore, the processing may consist of the transfer of personal data:

to judicial and administrative authorities such as the Regulatory Authority for the Gaming Sector and Similar Practices (ARSJPA);
-
to GUINEE MILLIONS' suppliers whose services are inseparable from the use of the Site and whose list is available upon request from the Contact mentioned in Article 7.5.
Purposes of data processing
GUINEE MILLIONS processes the personal data referred to in Article 2.1.a) for the purpose of authenticating the Players and allowing them access and use of the Site; therefore, this processing is carried out to ensure:

Article 3 - Processing of personal data requiring the consent of the Players
By using the Site, the Player expresses their free, specific, informed, and unequivocal will to expressly authorize GUINEE MILLIONS to process personal data within the limits and for the purposes defined below and without prejudice to the data processing referred to in Article 2.
The personal data communicated by the Player are recorded in a registry as described in Article 7.1, which is controlled and remains under the responsibility of GUINEE MILLIONS.
The Player also benefits from rights including the right to withdraw their consent at any time according to the modalities defined in Article 3.4.
3.1. Type of data
The data processed by GUINEE MILLIONS include:

3.2. Processing of data
The processing consists of the collection, recording, preservation, consultation, organization, use, and matching of personal data described in Article 3.1. It also includes the transfer of this personal data to third parties whose list is available upon request from the Contact mentioned in Article 7.5.
3.3. Purposes of data processing
The personal data are collected and processed by GUINEE MILLIONS for the following purposes:

the promotion, advertising, and marketing including affiliation and management of loyalty programs related to the service offerings of online games including sending SMS, telephone calls, paper or electronic newsletter not falling under the scope of Article 2.2.c);

participation in contests and promotional offers including communication about the winners;
-
the development of new games and betting offers;
-
the conduct of satisfaction surveys, statistical studies, trend analyses, and market studies for the purposes of management, marketing, and reporting including profiling not falling under the scope of the purpose described in Article 2.2.c).
Article 4 - Rights of the Player if subject to the GDPR
Without prejudice to Articles 2 and 5 of this Privacy Policy, Players have the right to exercise a right of rectification, opposition, and limitation according to the modalities and limits as follows:
4.1. Right of access
GUINEE MILLIONS makes available to Players all the following information:

the identity and contact details of the data controller;

the contact details of the data protection officer;
-
the personal data processed;
-
the purposes of the processing for which the personal data are intended as well as the legal basis for the processing;
-
the recipients or categories of recipients of the personal data, if applicable;
-
if applicable, the fact that the data controller intends to transfer personal data to a country outside the European Union and: either the existence (or absence) of an adequacy decision made by the European Commission or, in the absence of such a decision, the guarantees offered by the third country and the means implemented to obtain a copy of the personal data;
-
the possibility to object to automated processing of their data such as profiling, unless justified reasons make this processing by GUINEE MILLIONS necessary, and the possibility to object to any processing of their personal data for marketing purposes.
Players have the right to request at any time access to all information stated in this article and in Article 3.1 by contacting the Contact mentioned in Article 7.5. GUINEE MILLIONS will respond to these requests for information within a period of one month.
Players have the right to obtain a copy of the personal data being processed. GUINEE MILLIONS reserves the right to claim payment of any fees possibly induced by this request; these fees will be calculated based on the administrative costs induced by the request; they will not exceed 20 euros.
Players have the right to obtain in a structured format this access or said copy in such a way that the personal data are provided in a format consistent with the technical standards in force at the time of the access request; this format will therefore be machine-readable.
4.2. Right of rectification
GUINEE MILLIONS guarantees and obliges Players to update and rectify the personal data concerning them as soon as these data are incorrect or incomplete.
This right of rectification can be exercised on request to the Contact mentioned in Article 7.5.
4.3. Right of opposition
GUINEE MILLIONS allows Players to oppose the processing of all or part of the personal data concerning them for the following reasons:

their data are inaccurate;

the processing is no longer necessary for the purposes for which the data were collected;
-
the Player withdraws their consent;
-
the data have been subject to unlawful processing.
GUINEE MILLIONS further allows Players to oppose:

automated processing of their data such as profiling unless justified reasons make this processing by GUINEE MILLIONS necessary;
-
any processing of their personal data for marketing purposes, including profiling if it is linked to this prospecting.
This right of opposition can be exercised on request to the Contact mentioned in Article 7.5.
4.4. Right to be forgotten
GUINEE MILLIONS also undertakes to respond to any request for deletion of personal data as soon as possible (right to be forgotten) when:

the processing is no longer necessary for the purposes for which the data were collected;
-
the Player withdraws their consent;
-
the data have been subject to unlawful processing or must be deleted pursuant to a legal obligation;
-
the Player opposes automated processing of their data such as profiling and there are no justified reasons making this processing by GUINEE MILLIONS necessary;
-
the Player opposes processing of their personal data for marketing purposes, including profiling if it is linked to this prospecting.
4.5. Right to limitation
Players also have the right to obtain from GUINEE MILLIONS a limitation of the processing of their personal data when:

the Player considers that their personal data are inaccurate, for the time necessary for GUINEE MILLIONS to verify the accuracy of these data;
-
the processing is unlawful but the Player does not wish the deletion of the data but requires a limitation of processing of these data;
-
the Player opposes automated processing, including profiling, or processing of their personal data for marketing purposes and it is necessary to verify the legitimate grounds for which GUINEE MILLIONS intends to maintain this processing;
-
GUINEE MILLIONS no longer needs the processed personal data but the person concerned wishes them to be preserved for the establishment, exercise, or defense of legal claims.
This right to limitation can be exercised on request to the Contact mentioned in Article 7.5.
4.6. Transfer of personal data to a data controller
Players are authorized to transfer their personal data to another data controller without GUINEE MILLIONS making it difficult.
As far as such a transfer is technically possible, Players are authorized to request GUINEE MILLIONS to have this transfer carried out directly by its data controller.
4.7. Modalities
The rights recognized by GUINEE MILLIONS to the Player must be exercised according to the modalities defined in Article 7.5.
4.8. Notification
GUINEE MILLIONS will provide the Player with a notification of any deletion or rectification of data in accordance with Articles 4.2 and 4.4, unless such notification proves impossible or imposes disproportionate efforts.
Article 5 - Location, preservation, and duration of personal data storage
GUINEE MILLIONS retains the personal data of the Players in a form that allows their identification and availability and follows appropriate and secure means.
The personal data of the Players are stored in Guinea by GUINEE MILLIONS for the purposes defined in Articles 2 and 3, which present the necessary and useful security guarantees in view of the technical standards in force.
They are kept for a period of 10 years for all purposes governed by Article 2.a); GUINEE MILLIONS consequently reserves the right to retain the personal data of the Players for any purposes that may be imposed on it by law due to its online gaming activities.
The personal data are stored for a duration not exceeding that necessary to achieve the purpose of the processing for all purposes governed by Article 2.2 and 3. The data are then erased from the files of GUINEE MILLIONS upon request from the Players addressed to the Contact mentioned in Article 7.5.
Article 6 - Liability of GUINEE MILLIONS and its subcontractors
GUINEE MILLIONS is committed to ensuring that the processing of personal data of the Players is carried out in a lawful, fair, and transparent manner with respect to the Player concerned. Any processing by GUINEE MILLIONS will be in accordance with this Privacy Policy.
GUINEE MILLIONS implements all reasonable and appropriate means to ensure the confidentiality, integrity, and availability of the personal data it processes.
Technical measures include in particular the anonymization and encryption of personal data according to the required purpose.
Organizational measures include in particular the performance of internal audits in addition to the audits to which GUINEE MILLIONS may be subject by the Regulatory Authority for the Gaming Sector and Similar Practices (ARSJPA).
The personal data of the Players are not transmitted to third parties other than the suppliers and partners of GUINEE MILLIONS except for the purposes described in Articles 2.1, 2.2, and 3, and therefore if:

the transfer is made mandatory by law, a regulation, or an injunction from an administrative or judicial authority;
-
the transfer proves necessary for the provision of online gaming and sports betting services or for maintenance services;
-
the Player has given their consent for such a transfer.
The partner will not be considered a subcontractor unless they process the personal data of the Players on behalf of GUINEE MILLIONS. GUINEE MILLIONS disclaims any liability for the processing of the Player's personal data by the partner who provides its own services in its own name and for its own account or if it proves that the event causing the damage is not attributable to it.
In the event that GUINEE MILLIONS acts as a subcontractor of the partner, it is agreed that GUINEE MILLIONS will not be held liable for damage caused by processing of personal data contrary to this Privacy Policy unless GUINEE MILLIONS has not complied with its obligations under this Privacy Policy specifically incumbent on subcontractors or if it has acted outside or contrary to the lawful instructions of the partner. Likewise, the liability of GUINEE MILLIONS can in no case be engaged if it proves that the event causing the damage is not attributable to it.
GUINEE MILLIONS ensures that when the processing is carried out by a subcontractor on behalf of GUINEE MILLIONS, this subcontractor presents sufficient guarantees regarding the implementation of appropriate technical and organizational measures and more generally compliance with applicable legal requirements.
GUINEE MILLIONS will also inform the Players concerned as long as the violation of personal data presents a high risk for the rights and freedoms of the Player; this information will be carried out by email or mail to the contact details communicated by the Player.
Article 7 - Miscellaneous
7.1. Register of personal data and Information Security Manual
As the data controller of personal data, GUINEE MILLIONS maintains a register of all its processing activities. This register contains all the information relating to the type of data processed, the individuals concerned by the data processing, the eventual recipients to whom these data are communicated, if applicable, the purposes for which the data are processed, the duration of data storage, and a general description of the technical and organizational security measures implemented.
The personal data communicated by the Player are recorded as well as the processing and their purposes in a registry which is controlled and remains at all times under the responsibility of GUINEE MILLIONS. This registry includes, in addition to the aforementioned information:

a description of the purposes of the processing;
-
a description of the categories of individuals concerned and the categories of personal data;
-
the categories of recipients to whom the personal data have been or will be communicated, including recipients in third countries or international organizations;
-
the planned deadlines for the deletion of different categories of data;
-
a general description of the technical security measures.
7.2. Completeness - modification of the Privacy Policy
The Privacy Policy contains all the contractual provisions enforceable against the Players without prejudice to the general provisions contained in the Terms of Use of the Site of which they are an integral part. The Terms of Use of the Site therefore remain applicable for any question not relating to the protection of personal data.
GUINEE MILLIONS also reserves the right to modify the Privacy Policy.
Any update is enforceable against the Players as soon as it is published on the Site. GUINEE MILLIONS will ensure to mention the date of posting of the current Privacy Policy on the Site.
7.3. Probative value
The Player recognizes the same probative value to electronic documents exchanged and to electronic data collected within the framework of their registration or use of the Site as if these documents and data had been communicated or collected on paper. They therefore undertake not to contest their force nor their probative value due to their electronic support.
